LEAD TIME
All lead times quoted are estimates only. aZüra Stoneworks is not responsible for unforeseeable delays caused by factory delays, shipping, customs etc. It is the clients responsibility to notify the end buyer that delays can happen and no liability will be assumed by aZüra Stoneworks for consequential damages due to a delay.
Lead times quoted begin upon receipt of a signed confirmation and deposit.
The target ship date is a target date only. Actual ship date may vary from estimate.
We do everything possible to ship orders on time. However, the custom nature of our manufacturing processes may result in occasional delays on orders. Please add appropriate buffer period when quoting delivery dates to your customer.
We recommend that you do not schedule installation until you are in receipt of the entire order. Azura Stoneworks will not pay any rush freight charges for orders that are shipped after the target ship date.
ORDER CHANGES & REVISIONS
All changes to established purchase orders must be in writing, and clearly identified on the revised purchase order. Verbal changes will not be accepted.
Container shipments: Changes to container shipments must be made before a deposit has been placed for the order. Changes and revisions after this date will result in additional charges, and/or changes to the target ship date.
Warehouse stock shipments: Changes to stock shipments must be made within 24 hours after you receive the confirmation of your purchase order.
The effective date of the revised order is when Azura Stoneworks has received a signed order revision notice by fax or email within the allotted time permitted.
CANCELLATIONS
Container shipments: No cancelations of container orders will be accepted after 5 business days of Azura Stoneworks receiving a deposit for the order. Cancelations after the cut-off date, or without approval, deems the entire deposit non refundable. Unfortunately, due to the custom manufacturing of our products, once work begins we have significant costs that we immediately incur. An order that has been approved for cancelation will be subject to a 10% cancelation fee.
Warehouse stock shipments: No cancelations of stock orders will be accepted after payment has been processed.
Late Cancelation and Returns: After payment has been processed, any late cancelations or returns are subject to Azura management approval and are subject to a 25% restocking fee.
PRICING Prices are subject to change without notice.
PAYMENT
Special Orders: Due to the custom manufacturing process, a 50% deposit is required for all custom orders. Payment in full is required before the container/shipment will be released. We reserve the right to require full payment in advance.
Warehouse Stock Orders: All stock product must be paid for in full before leaving the warehouse. Certified check (cheque), or verified bank transfer is the preferred method of payment.
All credit card payments will be subject to a 3.5% bank charge.
SAMPLE ORDERS Loose samples are available upon request. Charges for samples and shipping must be paid by the client unless other arrangements have been made. Once an order is made, the shipping charges for the samples will be deducted from the order total.
FOB STOCK / CONTAINER Ownership of all material is transferred to the customer as soon as it leaves the warehouse.
LTL TRUCK SHIPMENTS
All orders must be shipped palletized and be delivered via truck. All truck shipments will ship freight collect or 3rd party billing with no exceptions.
Special shipping instructions must be included on the purchase order. Include instructions such as: 3rd party billing to a separate address, curb side delivery, call before delivery (CBD), telephone numbers, business or residential delivery, inside delivery, and freight collect to the end user, or anything special to assist in the final acceptance of your order and its destination.
SHIPPING CHARGES Our freight class is 60. aZüra Stoneworks does not estimate or obtain shipping charges. Tile weights are found in the 'Technical Information' page that can be found on the individual product page. This information can assist when inquiring for shipping estimates.
PACKAGE AND HANDLING FEES Package and handling fees on all orders have a varying rate. Please contact a sales representative for more information.
UPS/FED EXPRESS GROUND SHIPMENTS All UPS/Fed Express shipments will ship by customer number, unless other arrangements are made in writing prior to shipment.
DHL / AIRBOURNE We do accept DHL shipments on your account. Please provide account number and the owner of the account with your purchase.
FREIGHT CLAIMS LTL
All aZüra Stoneworks truck shipments are palletized. They are neatly stacked, then banded to reduce movement. The entire pallet is then shrink wrapped. Address labels are then adhered to the outside of the shrink wrap. Packing lists are placed in an envelope and attended to box #1. If there are multiple orders on the pallet, each one will have a packing list.
Your pallet leaves in the above mentioned condition. If any of the above is not true when shipping arrives, take written exception upon the delivery receipt and have the driver sign your exception. Please inspect and check your shipment thoroughly upon arrival - inspect for damage or missing cartons. Every order has a packing slip attached to BOX 1 of the shipment. Review for damage and completeness of your order. Damage, whether obvious or hidden, or shortages must be reported to the trucking company within 5 days of receipt to avoid waiving claims. Sole responsibility for damage or shortages rests upon the receiving company. Do not refuse an order due to its condition. Take written exceptions on the driver's delivery receipt. Follow your company's claim procedures to expedite the tile replacement at the trucking company's expense. Contact Azura Stoneworks with a replacement Purchase Order for damage or loss. Hold all packaging materials for inspection by your trucking company.

SHIPPING CHANGES All changes must be made in writing. Fax any changes to your customer service representative, and request confirmation that a change notice has been received.
TERMS
Conditions of Purchase: Marble and limestone, as with other stones such as travertine and granite are products of nature and no two pieces are alike. Prior to installation, it is important to lay out all material for necessary blending. This will ensure satisfactory results. The customer should supervise the installation.
Color Consistency: Due to the nature of natural stone we do not guarantee color matching from shipment to shipment. The product delivered may vary from both the original sample and brochure. We do not warrant all tiles will be identical in color, shade and texture and specifically disclaim that part of any warranty of merchantability. Any samples sent out are only indicators to the character of the product, not to represent that the tile will necessarily conform to the sample.
Caution: When installing over concrete slab, or at ground level, use additional caution to levelness and moisture content. Please refer to ANSI for full technical installation guidelines.
Damage: Buyer must notify within 5 business days of any significant damage or manufacturer defects in the shipment. Clear photos of the damage upon receipt of the order must be provided by email. These photos should be taken immediately upon receiving the product, or upon first opening/discovery of damage.
Hold Policy: For shipments that require staging or temporary storage, additional charges will apply based directly on the costs of services provided by third party companies.
Absolutely no claims will be accepted for any reason after material is installed. Use constitutes full acceptance.
LIMITS OF LIABILITY
Our responsibility is expressly limited to the replacement of goods proved defective. As with all natural marble and stone, our products are not guaranteed against staining, chipping, scratching, absorbing or loosening of setting bed. aZüra Stoneworks' only obligation shall be to replace such a quantity of product as agreed to be defective, less any courtesy product when provided. aZüra Stoneworks shall not be liable for any injury, loss or damage, direct or consequential, arising out of the use or the inability to use the product. There is no warranty for merchantability or fitness for the purpose of the product. User shall determine the suitability of the product for his intended use prior to purchase. User assumes all risk and liability whatsoever in connection with the installation of the product.
INSTALLATION We shall in no way be responsible for the installation of our tiles or thereafter. We extend no guarantees, expressed or implied, as to slipperiness, wear resistance, breakage, or maintenance procedures. An experienced trades person should select, blend, and set the tiles and follow the installation guidelines provided by TCNA Tile Council of North America. QUALITY TESTING
To provide the best possible quality, all aZüra Stoneworks' products are tested by the Tile Council of North America for Bond Strength and Freeze/Thaw. aZürastone exceeds Tile Council of North America's ASTM Bond Strength Test C-482 including Freeze/Thaw
